Lease for Ceidrim Terrace 1899

The above image is a photograph of the original lease from the Gellyceidrim Collieries Company Limited, allowing Richard Evans to build houses. Ceidrim Terrace was a group of houses on what is now Cwmamman Road, Glanamman. Eventually, other houses were built behind this terrace, namely what is now Ceidrim Road and New Ceidrim Road, Glanamman. In the past, Ceidrim Terrace was known locally as "Hellfire Row", due to the reputation of the occupants for not always getting along with each other!

The above document was signed and sealed in 1899. The text of the document is shown below, though it makes no easy reading, due in part to its lack of punctuation:

This Indenture made the sixteenth day of September One thousand eight hundred and ninety nine Between the Gellyceidrim Collieries Company Limited whose registered Office is situate at number 13 Cambrian Place in the County Borough of Swansea (hereinafter called the Lessors) of the one part and Richard Evans of Godrerwaun Glanamman in the county of Carmarthen collier (hereinafter called the Lessee) of the other part Witnesseth that in consideration of the expenses to be incurred by the Lessee in erecting and finishing the messuage and building hereinafter mentioned and of the rent and Lessees covenants hereinafter reserved and contained They the Lessors do hereby appoint demise and Lease unto the Lessee All that piece or parcel of ground being part of Pistyll Llwyd Farm situate at Glanamman in the Parish of Bettws in the County of Carmarthen containing by admeasurement sixty four and a quarter perches or thereabouts which said piece of ground intended to be hereby demised with the dimensions and boundaries thereof is shown and delineated on the plan drawn on these presents and thereon coloured pink Together with power for the Lessee to erect and build upon the said piece of ground four messuages or dwellinghouses as hereinafter mentioned and no more (except and always reserved out of this demise unto the Lessors or other the person or persons for the time being entitled thereto all mines veins and seams of coal culm ironstone fireclay and all other minerals contained in and under the said ground and premises hereby demised Together with full rights and powers for the Lessors to search for get work convert and carry away the said coal culm ironstone and all other minerals in connection with any foreign minerals or otherwise and for the purposes aforesaid or any of them to enter upon use and occupy the surface of the said hereditaments and to erect such buildings on the said premises as may be found needful or convenient for the habitation and use of the agents colliers and other persons to be employed in the mines collieries or other works to be worked or carried on under the powers hereby reserved with power to remove alter pull down or carry away the same as occasion may require making reasonable compensation for any injury which may be occasioned to the said surface by reason of the exercise of the rights and powers herein reserved. To have and To hold the said premises hereby demised unto the lessee from the twentyninth day of September One thousand eight hundred and ninety nine for the term of Ninety nine years thence next ensuing subject to the provisions of the Public Health Acts and the rules and orders of the Sanitary Authority for the time being of the District within which the said premises are situate Yielding and Paying therefor during the said term the yearly rent of Four Pounds sixteen shillings and four pence by two equal half yearly payments on the twentyfifth day of March and the twentyninth day of September in each year without any deduction whatsoever (except the property or income tax) the first of such half yearly payments to be made on the twentyfifth day of March One thousand nine hundred And the Lessee hereby covenants with the Lessors that he the Lessee will pay unto the Lessors the said yearly rent hereby reserved at the times and manner aforesaid And also will during the said term pay all taxes rates tithe rent charge charges duties assessments and outgoings whatsoever which now are or may be charged or assessed upon the said premises hereby demised or the messuages and buildings erected thereon or on any person or persons in respect thereof (the property tax only excepted) And also will at his own cash and charges within one year from the date hereof erect build and completely finish fit for habitation upon the said piece of land hereby demised one messuage or dwellinghouse with all necessary conveniences thereto the front of such messuage or dwellinghouse to be similar to and in conformity as regards elevation and otherwise with the plans and specifications to be first approved by the Lessors And also will within two years from the same date in like accordance with the said plans and specifications erect build and completely finish the remaining three messuages or dwellinghouses hereby authorised to be erected And also will at all times hereafter during the said term whether any notice shall have been given for the reparation of the same or not well and substantially repair uphold maintain paint pave cleanse and keep in repair the said dwelling houses and premises and all other buildings which may at any time hereafter be erected and built upon the said hereby demised premises or any part thereof and all walls pavements privies sinks sewers drains watercourses and other the appurtenances thereto belonging with all necessary reparations and amendments whatsoever And Particularly shall and will erect and set up upon the said piece of land and in connection with each of the said messuages or dwellinghouses a good and serviceable ash privy and keep the same in good repair and condition during the said term And will in particular paint with at least three coats of good oil colour and in a proper and workmanlike manner the outside wood and ironwork of the said premises and all gates and railings once in every three years of the said term and also will paint with two coats at least of good oil colour such parts of the inside of the said messuages and premises as are usually painted once in every seven years of the said term the last painting both inside and outside to be made in the year immediately preceeding the determination of this Lease whether by effluxion of time or otherwise And will at the same time with every outside painting restore and make good the outside stone and brick work whenever necessary and at the same time with every inside painting whitewash and colour such parts of the inside of the said messuages or dwellinghouses and premises as are usually whitewashed and coloured And will also on demand pay a reasonable share and proportion for and towards the costs and expenses of making supporting keeping and repairing all existing roads or intended roadways adjacent to the said piece or parcel of ground and all or any pavements in the front or in the rear of the said premises and all sewers and drains which now are or at any time during the said term shall belong to the said premises or any part thereof in common with other messuages or tenements and such proportion shall be ascertained by the Surveyor or Agent of the Lessors as shall be recoverable as rent in arrear And Also will at all times during the said term pay one moiety of the cost of erection and repair of the walls of the said premises which are party walls And also will permit and suffer the rafters purlins beams and walls of any dwellinghouse or buildings to be erected on premises belonging to the Lessors or their Lessees adjoining the premises hereby demised to be inserted and placed in and against the pine ends and boundary walls of the dwellinghouses and buildings to be erected on the said hereby demised premises on payment in case of building against a plain pine end or boundary wall of one third part of the expense of erecting such last mentioned pine end and boundary wall and in case of building against a pine end built with recesses and fire places of one half part of the like expense And also will in all aspects abide by and perform the Bye laws of the Sanitary or Sewers Authority for the time being of the District within which the premises hereby demised are situate and the same premises being so well and substantially repaired upheld maintained painted paved cleansed and kept in repair will at the expiration or other sooner determination of the said term surrender and yield up unto the Lessors together with all erection buildings and all other things coming under the denomination of Landlords fixtures which shall be fixed or fastened to the said demised premises or any part thereof And further that it shall be lawful for the Lessors and their Surveyors Agents and Workmen twice or oftener in every year during the said term to enter upon the said premises or any part thereof to view the state and condition thereof and of the buildings thereon and of the sewers and drains appurtenant thereto and any defects or work of reparation then and these found to give or leave notice in writing at or upon the said premises or any part thereof for the Lessee to repair and amend the same and that the lessee will repair and amend the same accordingly within three calendar months from the date of such notice or notices respectively And also at any time during the last seven years of the said term to take a Schedule of the fixtures in and upon the said messuages or dwellinghouses and premises (not being tenants fixtures) And also that the Lessee will at all times during the said term insure and keep insured the messuages or dwellinghouses and buildings now or hereafter to be erected and built upon the said demised premises or any part thereof from loss or damage by fire in a sum equal to at least two thirds of the full value thereof in the office of the Scottish Union and National Insurance Company or some other good office to be approved by the Lessors in the joint names of the Lessors and Lessee and shall and will produce the last receipt for the premium in respect of such Insurance to the Lessors or their agent whenever required so to do and that the money to be received from such Insurance Office in case of loss or damage by fire shall be immediately applied in repairing or rebuilding as the case may be the said buildings which may be so destroyed or damaged by fire And also that the Lessee will not at any time during the said term erect any other buildings upon any other part of the said hereby demised ground except the messuages or dwellinghouses hereinbefore mentioned nor make any alteration in the plan or elevation of the said messuages or dwellinghouses or in any party wall without the consent in writing of the Lessors their Solicitors or Agent for that purpose first obtained and will not allow the said premises or any part thereof to be used for the sale of Beer or Spirits or do or suffer to be done any act or thing thereon which may be noxious noisome or offensive or be an interruption or annoyance to the tenants or occupiers of the premises adjoining or near thereto and shall not nor will without such licence or consent as aforesaid assign underlet set over or otherwise part with this present Indenture of Lease or the premises hereby demised or any part thereof for all or any part of the term hereby granted Provided Always that if the yearly rent hereby reserved or any part thereof shall be unpaid for the space of twentyone days after any of the days whereon the same is hereinbefore reserved to be paid as aforesaid and whether the same shall or shall not have been legally demanded or in case of any breach default or nonperformance of any of the covenants or agreements herein contained on the part of the Lessee then and in every such case it shall be lawful for the Lessors into and upon the said hereby demised premises or any part thereof in the name of the whole to reenter and the same to have again repossess and enjoy as of their former estate And the Lessors hereby covenant with the Lessee that the Lessee paying the rent hereby reserved and observing and performing the Lessees covenants hereinbefore contained shall peaceably and quietly hold and enjoy the said hereby demised premises and every part thereof with the appurtenants for the term hereby granted without any interruption by the Lessors or any person rightfully claiming under them And it is hereby declared that except when the context may require a different construction the expression "the Lessors" hereinbefore used shall be deemed to include the respective successors and assigns of the said Gellyceidrim Collieries Company Limited and the expression "the Lessee" shall be deemed to include the executors administrators and assigns of the said Richard Evans In witness whereof the said parties to these presents have hereunto set their hands and seals and the Gelliceidrim Collieries Company Limited have caused their Common Seal to be hereto affixed the day and year first above written.-

In 1931, Richard Evans assigned the rights to these properties to his children. The texts and plan, shown in the above image, are written on the reverse of the original lease.
